Conditions of participation – competition April 2nd 2021
The draw will be decided between all participants who follow Nyctophilia on Instagram/Facebook and like and comment on the competition post! The competition starts Friday, April 2nd 2021 4pm German time.
Closing date: Saturday, 3rd April 6pm German time.
The prize draw will take place on Saturday, 3rd April, on the Instagram/Facebook page of the Nyctophilia Shop. The winners will be notified in the comments and can claim their prize per E-Mail or DM.
As a prize, Nyctophilia OHG, Landwehr 5, 22087 Hamburg (“Nyctophilia”), which is the organizer of this competition, is raffling off two Nyctophilia Shirts on Instagram and two Nyctophilia Shirts on Facebook.
A cash payment of the prize is not possible. The prize can neither be selected nor exchanged. It is also not transferable.
All persons aged 14 and over who are permanently resident in the European Union are eligible to participate. Employees of Nyctophilia OHG and their relatives are not allowed to participate.
Posting objectionable, discriminatory, personality-attacking or similarly inappropriate posts is not permitted, and Nyctophilia reserves the right to delete these posts without giving a reason. Contributions to the competition may not contain any violations of competition, trademarks or copyrights. The purchase of products and services does not affect the outcome of the competition.
If a participant violates these conditions of participation, Nyctophilia reserves the right to exclude this participant from the competition.
Participants who use unauthorized aids or otherwise gain advantages through manipulation are also excluded. In these cases, Nyctophilia can also revoke and claim back winnings.
The winners will be notified in the same post and then have the opportunity to register by private message until Sunday 4th April 8 p.m. If a winner does not register within this time frame, the prize will be forfeited.
This raffle has no connection to Facebook and is neither sponsored, supported nor organized by Facebook. The recipient of the information provided by the user is not Facebook, but Nyctophilia. Nyctophilia releases Facebook from any liability. All questions, comments or complaints about the competition should be directed to Nyctophilia and not to Facebook.
Privacy Policy:
By participating in this competition, the participant expressly agrees that their personal data will be stored electronically and used to process the competition.
To participate in the competitions, the participant only has to provide the full Instagram name. This data is used by Nyctophilia exclusively for the implementation of the competition. In case of a win, participants have to provide their postal address for shipping. Winner data will be saved as far as this is legally required. However, they will then be blocked for further use. Please note that for those participants who are registered as fans of the Nyctophilia Instagram page, the data released by the participant in the profile of Nyctophilia remains visible.
In the event of revocation of consent to the storage of personal data, the participant can send a letter or an e-mail to the data protection officer of Nyctophilia, Landwehr 5, 22087 Hamburg, stating the keyword “Pin wall raffle Nyctophilia from 02/04/2021”. Germany, send chrissi@nyctophilia-shop.de. Upon receipt of a participant’s revocation, the personal data stored by Nyctophilia will be deleted immediately. Participants are requested to also contact the data protection officer of Nyctophilia in order to obtain information about which personal data of the participant has been stored in Nyctophilia. The objection means that the participant is excluded from participating in the Nyctophilia competition.
Nyctophilia reserves the right to cancel or end the competition at any time without notice and without giving reasons. Nyctophilia makes use of this option in particular if for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and / or software) or for legal reasons (e.g. changes to its own terms of use or guidelines) Facebook) a proper execution of the competition cannot be guaranteed. If such a termination is caused by the behavior of a participant or in the event that a participant violates these conditions of participation, Nyctophilia can demand compensation from this person for the resulting damage.
Upon delivery of the prize, Nyctophilia is released from all obligations. Nyctophilia is only liable for legal and material defects in the event of intent or gross negligence. Any claims that relate to the profit received are to be addressed directly to the person who issued and transferred the profit. Nyctophilia is not liable for damage caused by errors, delays or interruptions in transmission, malfunctions in the technical systems and service, incorrect content, loss or deletion of data, viruses or in any other way when participating in competitions.
The liability limitations do not apply if the damage is caused by Nyctophilia (its organs, employees or vicarious agents) intentionally or through gross negligence or if it is an essential contractual obligation.
The judges’ decision is final. Only the law of the Federal Republic of Germany is applicable. Should individual regulations of these conditions of participation be or become invalid, the validity of the other conditions of participation remains unaffected. These conditions of participation can be changed by Nyctophilia at any time without separate notification.
